Laboratoire ODOST reserves the right to modify these general conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.

PRODUCTS

Products

In accordance with Article L. 111-1 of the Consumer Code, the User may, prior to his order, take note, on the Site www.castera-thermal.com, of the essential characteristics of the product (s) he wish to order.

The buyer selects one or more products from the different categories offered on the website www.castera-thermal.com.

The offers presented by the ODOST laboratory are valid while stocks last. The ODOST Laboratory reserves the right to modify the range of products depending in particular on the constraints related to its suppliers.

The photographs, graphics and descriptions of the products offered for sale are indicative only and do not bind the seller.

Price

The selling prices of the products online on the website www.castera-thermal.com, indicated in euros, are those in force at the time of registration of the order form by the Purchaser.

They do not include shipping costs, billed in addition to the price of products purchased according to the amount of the order. Shipping costs will be indicated before the order is placed by the Buyer.

Prices include value added tax (VAT) applicable on the day of the order and any change in the applicable rate will automatically be reflected in the price of products sold by Laboratoire ODOST on its website.

For orders invoiced outside French territory, invoicing will be exclusive of tax.

The selling prices of the products can be modified by Laboratoire ODOST at any time. This change will be notified to the Buyer before any order.

REGISTRATION AND VALIDATION OF THE ORDER

Ordered

If the User wishes to place an order, he will choose the different Products in which he has an interest, and will express the said interest by clicking on the "Add to basket" box.

At any time, the Buyer may :

- obtain a summary of the Products he has selected or modify his order, by clicking on "Basket",

- continue to select Products by clicking on the "continue shopping" icon,

PAYMENT

The price is payable in cash, in full on the day the order is placed by the buyer, by secure payment by credit card, bank transfer or check. The Odost laboratory will not be required to deliver the products ordered by the Buyer if the latter does not pay him the full price.

Payments by credit card are debited when ordering.

Payments made by the Buyer will only be considered final after actual receipt of the sums due by Laboratoire Odost.

In the context of payment by Bank Check, the sale will only be considered concluded and therefore shipped upon receipt and validation of the check by Laboratoire Odost.

The Odost laboratory reserves the right, in the event of non-compliance with the payment conditions set out above, to suspend or cancel the delivery of orders in progress made by the buyer.

CHOICE OF PRODUCTS

The Purchaser having taken note of the products and their characteristics, marketed by Laboratoire ODOST, has under his sole responsibility and according to his needs as they have previously determined before any order, made his choice on the product (s) being the subject of his order. In addition, the Buyer, knowing only the products he owns and uses, is the sole judge of the compatibility of the products ordered with those used by him.

DELIVERY AND RECEPTION

General rules

For any order less than or equal to 35 Euros including tax, a contribution to the shipping costs will be applied.

Our prices indicated are those for shipments to mainland France (excluding Corsica). For a delivery in Corsica, in the islands, a sure cost will be applied (more details on the page "delivery and returns").

Packages are shipped via the chosen mode of transport. The items are delivered to the delivery address specified when ordering. The sending of the order will be confirmed to the customer on the day of his departure by e-mail provided that the customer has correctly communicated his e-mail address. The postage fees are paid by the client. Delivery costs appear separately on the order form before confirmation by the customer, with some exceptions.

If the package is not delivered directly, a notice of availability is issued by the carrier.

If the package is not collected within the time limit, the package will be returned to the ODOST laboratory. In this case, it may be returned to the customer provided that the latter again pays the shipping costs and a lump sum of 15.50€

As transport takes place at the risk and peril of the Customer, it is recommended that the latter check the packages as soon as they arrive. In the event of apparent defects, the customer has the right of return specified in article 8. The times indicated when ordering are given as an indication and may vary depending on the destination. The ODOST laboratory undertakes to ensure that the products ordered by the Buyer are delivered as soon as possible. Delivery times are given for information only and any overrun may not give rise to any damages, withholding or cancellation of the order by the Purchaser. Except in special cases or unavailability of one or more products, the products ordered will be delivered at one time.

However, if the products ordered have not been delivered within a reasonable time after the indicative delivery date, for any reason other than force majeure, the sale may be canceled at the written request of the Purchaser or the ODOST Laboratory. The sums paid by the Purchaser will then be returned to him without delay, to the exclusion of any compensation or withholding. Delivery is deemed to have been made as soon as the products ordered by the ODOST Laboratory are handed over to the carrier who has accepted them without reservation.

Orders are processed Monday through Friday.

The preparation of your order and the average delivery time are 48 hours (working days).

Product unavailability

The Products are offered within the limits of available stocks. If one of the Products is unavailable, the Buyer will be informed as soon as possible. This information may be notified to him, as far as possible, as follows :

• when placing an order ;
• following the validation of his order, prior to delivery, by e-mail or telephone. The ODOST Laboratory will then take the necessary steps to subtract the price (s) of the unavailable Product (s) from the amount withdrawn from the Buyer's bank account, if the payment was made by credit card.

In all the aforementioned cases, the Purchaser will have the possibility of canceling his order by requesting either the reimbursement of the sums paid within thirty (30) days at the latest after their withdrawal, by e-mail addressed to the ODOST Laboratory, or 'exchange of unavailable Product (s). In the event of a product exchange, the delivery costs will be borne by the consumer.

RIGHT TO RETRACT

In accordance with Article L. 121-20 of the Consumer Code, the Purchaser has a period of seven (7) clear days from the date of receipt, to return at his own expense, the products ordered, for refund.

They must be returned to the ODOST Laboratory in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the return number obtained according to the procedure described in article 9 below. below.

When a buyer returns products, all risk associated with returning the product is the buyer's responsibility.

If the aforementioned conditions are met, Laboratoire ODOST will exchange the product or reimburse the Purchaser, within thirty (30) days, the sums corresponding to the products acquired by it.

RETURN OF PRODUCTS BY MAIL

To return an item, the buyer must first contact the ODOST Laboratory. He can do so by email to the ODOST Laboratory specifying the order number and the reference of the item (s) concerned as mentioned on the invoice.

ODOST Laboratory will not accept any return package unless it is accompanied by a return number. The ODOST Laboratory will also not accept parcels sent postage due.

Failure to comply with the procedure set out above and the deadlines indicated above, the buyer will not be able to make any claim for non-conformity or apparent defect of the delivered products, the products then being deemed to be compliant and free from any apparent defect.

PROPERTY RESERVE

The ODOST Laboratory retains full and entire ownership of the products sold until the price has been fully collected, in principal, costs and taxes included.

RESPONSIBILITY

The ODOST Laboratory cannot be held responsible for the non-performance of the contract in the event of a stock shortage or unavailability of the product due to a case of force majeure, disruption or total or partial strike, in particular postal services and means of transport. and / or communications.

The ODOST Laboratory cannot be held responsible for any direct or indirect damage that may occur as a result of the purchase of the products. Only the responsibility of the manufacturer remains fully engaged, in particular under articles 1641 and following of the civil code.

Laboratoire ODOST cannot be held responsible for any loss of data or files. It is the Buyer's responsibility to take all necessary safeguards.
